الملخص

لقد ارتكبت دولة الاحتلال الإسرائيلي العديد من الجرائم الدولية منذ اللحظة الأولى لسيطرتها على الأراضي الفلسطينية، وتعددت هذه الجرائم لتشمل الأشخاص والممتلكات العامة وعمليات الإستيلاء على الأراضي ومصادرتها وسياسة الفصل العنصري، فلم يعد أمام الفلسطينيين ككل إلا طريقه نحو القضاء الدولي من أجل ملاحقة “إسرائيل” على أفعالها غير المشروعة بحقهم، فتناولنا في هذا المقال بيان الوضع القانوني لفلسطين حسب قرارات الأمم المتحدة، وبيان الأفعال غير المشروعة المرتكبة بحق الفلسطينيين وشرح أليات جبر الضرر المترتبة عليها. ولقد توصلنا من خلال ما سبق أن فلسطين دولة غير عضو”مراقب” في الأمم المتحدة الأمر الذي يخول لها الحق في التوجه لمحكمة الجنايات الدولية لملاحقة دولة الاحتلال الإسرائيلي،ولكن على القيادة الفلسطينية الإستعداد للمعركة القانونية القادمة.

Abstract

The Israeli occupation state has committed many international crimes since the first moment of its control over the Palestinian lands, and these crimes have multiplied to include people and public property, the Iand grab and confiscation of lands and the policy of apartheid. The Palestinians had no other solution but to the international judiciary in order to prosecute Israel for its illegal actions against them. her illegal actions against them. In this article, we dealt with a statement of the legal status of Palestine according to United Nations resolutions, an explanation of the illegal acts committed against the Palestinians, and an explanation of the mechanisms of reparation from these illegal acts. We have concluded from the above that Palestine is a non-member “observer” state at the United Nations, which entitles it to go to the International Criminal Court to prosecute the Israeli occupation state, but the Palestinian leadership must prepare for the upcoming legal battle.
