الملخص

يظن البعض أن البصمة تتمثل في بصمة الأصابع فقط التي تساهم بشكل كبير في الكشف عن الجناة عند ارتكاب جرائمهم، إلا ان التحقق من شخصيتهم يمكن من خلال مجموعة من أعضاء الجسم البشري التي تترك توقيعا لصاحبها وتميزه عن غيره ولها دلالات في المجال الجنائي وتسمى البصمات المستحدثة وتشمل بصمات الاذن واللسان والاسنان والشعر والجينية وغيرها. وتكمن مشكلة البحث في محاولة الإجابة على السؤال الرئيس: ما هي البصمات التقليدية والمستحدثة المستخدمة في الاثبات الجنائي؟ وهدفت هذه الدراسة الى القاء الضوء على البصمات التقليدية وأنواع البصمات المستحدثة المستخدمة في الاثبات الجنائي واستخدم الباحث المنهج الوصفي، وخلصت الدراسة الى نتائج ومن أهمها: ان البصمات المستحدثة مثل بصمة العين والصوت والرائحة وغيرها من البصمات تعتبر من التقنيات الحديثة والدقيقة التي تساعد في منع الجريمة قبل وقوعها، وتعمل بدقة للتعرف على الجناة، وتعتبر البصمة الجينية (بصمة الحامض النووي DNA (من افضل الأساليب وادقها في التعرف على المجرمين في الوقت الحاضر. اهم التوصيات : يجب ان تتضمن التشريعات القضائية نص صريح وواضح يقضي بقيمة البصمات المستحدثة في مجال الاثبات الجنائي، ويجب الاعتماد على تطوير تحاليل البصمة الجينية في الإثبات الجنائي لما لها من أهمية في مجال العلوم الجنائية والتحقيقات والاثبات الجنائي ويجب على إدارة مختبرات الأدلة الجنائية توفير كل ما يلزم من أجهزة ومعدات حديثة، ودورات علمية لأفرادها حتى تسهل عملية تعاملهم مع البصمات المستحدثة في مسرح الجريمة.

Abstract

Some think that the fingerprint is the fingerprint only, which contributes greatly to the detection of the perpetrators when they commit their crimes, but the verification of their identity can be done through a group of members of the human body that leaves a signature for its owner and distinguishes him from others and has connotations in the criminal field. These are called modern fingerprints and include Ear prints, tongue, teeth, hair, genetics and others. And the research problem lies in trying to answer the main question: What are the traditional and new fingerprints used in criminal evidence? This study aimed to shed light on the traditional fingerprints and the new types of fingerprints used in criminal evidence. The study concluded with results, the most important of which are: that the newly developed fingerprints such as eye, voice, smell and other fingerprints are among the modern and accurate techniques that help prevent crime before it occurs, and work accurately to identify the perpetrators, and genetic fingerprinting (DNA fingerprint) is one of the best methods And the most accurate in identifying criminals at the present time. The most important recommendations: Judicial legislation should include an explicit and clear text that stipulates the value of the fingerprints created in the field of criminal evidence, and it is necessary to rely on the development of genetic fingerprint analyzes in criminal evidence because of their importance in the field of criminal sciences, investigations and evidence.
