الملخص

للدائرة التمهيدية دور مهم وفعال في مرحلة التحقيق أمام المحكمة الجنائية الدولية من أجل تأكيد التهم المنسوبة للشخص المتهم أو تبرئة المتهم من التهم المنسوبة إليه قبل إحالته للمحاكمة، حيث تهدف الدراسة إلى التعرف على أحد وأهمّ مكونات المحكمة الجنائية الدولية وهي الدائرة التمهيدية أو دائرة ما قبل المحاكمة في المحكمة الجنائيّة الدوليّة باعتبارها صرحاً قضائيّاً جنائياً دولياً، حيث نعتمد في الدراسة على المنهج الوصفي، من خلال وصف وتحليل النصوص القانونية الواردة في اتفاقية روما، ومن بين النتائج التي توصلنا اليها وهي أن الدائرة التمهيدية إحدى الضمانات الأساسية القضائية، بحيث لا يحال أي مشتبه به من أجل المحاكمة إلا إذا قررت الدائرة التمهيدية توافر أدلة كافية تستوجب التحقيق والمحاكمة، كما أن دور الدائرة التمهيدية مهم ومكمل لدور المدعي العام في عملية التحقيق، حيث يخضـع المدعي العام لرقابة الدائرة التمهيدية فيما يتخذه من قرارات تتعلق بالتصرف في التحقيق عند إقـرار الـتهم واعتمادها، ومن بين النتائج التي توصلنا اليها أنه يجب أن يتم إدخال تعديلات على نصوص النظام الأساسيّ للمحكمة الجنائيّة الدوليّـة؛ لسـدّ النقص الموجود والمشار إلى بعضه في النتائج، كما أنه يجب أن يتم إجراء التعديل المناسب على صلاحيات المدعي العـام للمحكمـة بحيث يتم منحه مزيدا من الصلاحيات.

Abstract

The Pre-Trial Chamber has an important and effective role in the investigation stage before the International Criminal Court in order to confirm the charges against the accused person or acquit the accused of the charges against him before referring him to trial. In the International Criminal Court as an international criminal judicial edifice, where we rely in the study on the descriptive approach, by describing and analyzing the legal texts contained in the Rome Convention, and among the results we reached is that the Pre-Trial Chamber is one of the basic judicial guarantees, so that no suspect is referred In order to prosecute, unless the Pre-Trial Chamber decides that there is sufficient evidence that requires investigation and trial. The role of the Pre-Trial Chamber is also important and complementary to the role of the Public Prosecutor in the investigation process, as the Public Prosecutor is subject to the supervision of the Pre-Trial Chamber in the decisions he takes related to the conduct of the investigation when the charges are approved and approved, and who Among our findings is that amendments must be made to the provisions of the Statute of the International Criminal Court. In order to fill the existing deficiency, some of which are referred to in the results, an appropriate amendment must be made to the powers of the Public Prosecutor of the Court so that he is granted more powers.
