الملخص

إن للمالكية نظرتهم الخاصة بهم في التعامل مع السنة الآحادية، وهذه النظر تولد عنها كثيرا من الأحكام الفقهية التي تكون مخالفة بشكل صريح للأحاديث الصحيحة، وهذا الأمر لطال ما سبب مشكلات كثيرة عند بعض الباحثين والمهتمين بهذا الحقل المعرفي، بشكل عام وعند البعض من المالكية بشكل خاص، وتأتي هذه الدراسة بهدف رفع هذا الإشكال وذلك بإظهار نظرة المالكية في التعامل مع السنة الآحادية مع الأمثلة التطبيقية. ولقد فرضت طبيعة هذه الدراسة أن يعتمد الباحث على المنهج الاستقرائي التحليلي، وتوصلت الدراسة إلى مجموعة من النتائج، أبرزها: إن المالكية لا مشكلة عندهم في العمل بالأحاديث المتواتر شأنهم في ذلك شأن غيرهم من المذاهب، وإما مشكلتهم في العمل بالأحاديث الأحادية، كما أنهم يعملون بالأحاديث الآحادية بشرط أن لا تخالف ظاهر القرآن، وأن لا تخالف عمل أهل المدينة، وأن لهم نظريتهم الخاصة في التعامل مع السنة الآحادية عند مخالفتها لظاهر القرآن وعمل أهل المدينة والقياس وقول الصحابي. وأوصت الدراسة بمجموعة من التوصيات، أبرزها: ضرورة أن يتريث الباحثون عند دراسة مخالفات العلماء للأحاديث وذلك في المواطن التي نجد فيها فتوى تخالف الحديث الصحيح، فضلاً عن دراسة في نظريات العلماء في التعامل مع الأحاديث، وذلك لأن للفقهاء نظرتهم الخاصة التي ربما تختلف عن الصنعة الحديثية.

Abstract

Malickism has its own vision as regards Sunna reported by a unique reporter, and this way has given way to numerous Fiqh rules that can be very different from Prophet authentic Hadith (sayings). Such a fact has caused a lot of problems for researchers and people interested by scientific field, in general, and some maleckists, in particular. This study is meant to try to find solutions for this issue through explaining maleckists’ point of view concerning how to deal with Sunna reported by a unique reporter in experimental examples. The nature of this study has made it necessary for the researcher to use the analytical methodology. So, among the main results the study has achieved, we mention the fact that Maleckism has no problem with adopting a Sunna reported by a great number of trustee reporters, just like the other Madhahibs (doctrines). As to their attitude towards the Sunna reported by a unique reporter, they consider it on the condition that it does not contract the clear meaning of the Holy Quran and the deeds of Medina people, otherwise, they have their own vision and interpretation. The study has concluded in adopting the following recommendations: The necessity for the researchers to deeply think when studying violating Sunna by scholars in places where we can find a Fatwa that goes against authentic Hadiths. And the need to really study scholars’ theories as to deal with the Prophet sayings, since Fukaha (scholars in Fiqh) may have their own way to deal with Sunna.
