الملخص

إذا كان المال قوام الحياة فإن الشرع الحنيف اهتم به ودعا إلى المحافظة عليه وجوداً وعدماً، وقد استنبط العلماء من استقراء نصوص الشريعة مقاصد كبرى موجهة للمعاملات المالية قصد التداول والتوزيع والحفظ والعدل فيها، ومن أبرزهم الإمام ابن دقيق العيد. وقد حاول الباحث تصنيف هاته الإشارات المقاصدية والبناء عليها وفق التشريعات التي قصدها العلماء النظار، مبرزاً فلسفة التشريع في المعاملات المالية عند هذا العلم الجلل. توصل البحث إلى مجموعة من النتائج أهمها أنَّ العلماء ومنهم ابن دقيق العيد من خلال استقرائهم لنصوص الشريعة توصلوا إلى استنباط موجهات كبرى للمعاملات المالية، سموها بالمقاصد، وجماعها: الرواج، والوضوح، والحفظ المزدوج، والإثبات، والعدل فيها. وأن مقصد العدل في المعاملات المالية يعتبر رافداً مهماً لتحقيق بقية المقاصد الأخرى.

Abstract

If money is the basis of life, then the true Sharia paid special attention to it and called for its preservation, whether it exists or not. Experts have deduced from the extrapolation of the texts of Sharia that major purposes are directed to financial transactions with the aim of circulation, distribution, preservation and justice in them, and the most prominent of them is Imam Ibn Daqiq al-Eid. The researcher tried to classify these intentional signs and build on them according to the legislation led by the principal experts, highlighting the philosophy of legislation in financial transactions with this great Imam. The research reached a set of results, the most important of which is that the scholars, including Ibn Daqiq al-Eid, through their extrapolation of the texts of Sharia, reached to derive major directions for financial transactions, which they called the purposes, and their combination: popularity, clarity, double preservation, proof, and justice in them. And that the purpose of justice in financial transactions is an important tributary to achieving the rest of the other purposes.
