الملخص

تهدف هذه الدراسة إلى بيان أنواع الأموال الموقوفة والكشف عن أثرها على الاستثمار، وذلك من خلال عرض تفصيلي للأموال الموقوفة وأنواعها وتحديد الأنواع الأكثر تأثيرًا على الاستثمار، إذ تختلف الأموال الموقوفة من حيث نوعها باختلاف الشيء الموقوف نفسه، فقد يكون المال الموقوف عبارة عن أموال منقولة أو عقارية أو حقوق معنوية، وقد يكون المال الموقوف مفرزًا بصورة مستقلة، أو يكون مشاعًا، ولكل نوع من الأموال الموقوفة شروط بوقفها، تؤثر هذه الشروط في بعض الأحيان على استثمار ذلك المال الموقوف. من أجل تحليل هذه الإشكالية اعتُمِد المنهج الوصفي الاستقرائي واستُنِد إلى تحليل المحتوى للتوغل أكثر في الموضوع، توصَّل البحث إلى عدة نتائج، أهمها انقسام وتباين رأي الفقهاء المسلمون حول وقف المنقول الذي لم يَرِد فيه أثرٌ بوقفه، فلَم يُجِز بعضهم وقف المنقولات والتي أصبح لها الأثر الكبير في الاستثمار، أما عن التوصيات فأبرزها ضرورة إدارة الأموال الموقوفة باستخدام إحدى أساليب الإدارة الحديثة، وكذلك الاستفادة من الطرق المعاصرة في كيفية استثمار الأموال بصورة عامة، وبما لا يتعارض مع شرط الواقف.

Abstract

This study aims to clarify the types of endowed funds and reveal their impact on investment, through a detailed presentation of the endowed funds and their types, and to identify the types that have the most impact on investment, as endowed funds differ in terms of their type depending on the endowed thing itself; the endowed money may be movable or real estate or moral rights. Also, it may be sorted separately, or it may be rumored. Each type of endowed money has conditions for endowing it. Therefore, these conditions sometimes affect the investment of that endowed money. In order to analyze this problem, the descriptive and inductive approach was adopted, and content analysis was based on getting deeper into the topic. The research reached several results, the most important of which is the division and divergence of Muslim jurists’ opinion on the endowment of movable property, which had no evidence on endowing it. Thus some of them did not allow the endowment of movables, which had a significant impact on investment. According to the recommendations, the most prominent of which is the necessity of managing endowed funds using one of the modern management methods, and also taking advantage of contemporary methods in how to invest money generally, in a manner that does not conflict with the condition of the endower.
